Project Process

- Design & Development: Upon approval of the proposal, our team begins the design and development process, providing regular updates and opportunities for feedback.
- Launch: Once the project is complete and approved, we launch your website or application and provide any necessary training or support.
Client Responsibilities
As a client, you agree to:
- Provide accurate and timely information necessary for the completion of the project
- Review and provide feedback on deliverables within agreed-upon timeframes
- Obtain all necessary rights and permissions for any content, images, or third-party elements to be included in the project
- Pay all invoices according to the agreed-upon payment schedule
Intellectual Property
Unless otherwise agreed in writing, Phoenix Digital retains ownership of all code, designs, and other deliverables created for client projects. Upon full payment, the client is granted a non-exclusive, perpetual license to use the deliverables for their intended purpose.
Hosting and Maintenance
For clients who engage our hosting services, we will make every effort to ensure the availability and performance of your website. However, we are not responsible for any downtime, data loss, or security breaches caused by factors outside our control, such as server failures or cyber-attacks.
Clients are responsible for maintaining and updating any CMS, plugins, or third-party software used on their websites to ensure security and compatibility.
Termination
Either party may terminate the agreement at any time with written notice. Upon termination, the client is responsible for paying any outstanding invoices for work completed up to the termination date.
Limitation of Liability
Phoenix Digital is not liable for any indirect, incidental, special, or consequential damages arising out of or related to the use of our services, including but not limited to lost profits, business interruption, or loss of data.
Governing Law
These Terms of Service are governed by the laws of Georgia. Any disputes arising out of or related to these terms or our services shall be resolved through arbitration in accordance with the rules of the American Arbitration Association.
Changes to These Terms
We reserve the right to update or modify these Terms of Service at any time without prior notice. Your continued use of our site and services after any changes constitutes your acceptance of the new terms.
